Non-Primary parcels (easements)

This article contains information on the capture of Non-Primary Parcels (Easements).

Note:

Where we use the term underlying, we mean spatially defined ‘live’ parcels or ‘approved’ parcels in Landonline.

How do I identify underlying non-primary parcels in Landonline?

  1. Open Layers from the Tools control toolbar.
  2. Under Parcels, select the arrow next to Underlying parcels to expand the panel.
  3. Turn on Approved and Live parcel layers.

  4. All underlying parcels are now visible in the spatial display. Use the Inspect and adopt tool to select and view information about an underlying parcel.

A. New easement parcel (over a parcel under survey) on an LT Subdivision

B. New appurtenant easements (new easements that are over primary parcels other than the land under survey)

* You need to extinguish existing appurtenant easements where the new easements:

  • are captured over existing easement parcels in the same layer.
  • cross over existing easements in the same layer. Capture the intersections and give new parcel appellations for each portion of parcel created for the new and existing easements.

You do not need to extinguish easements where there are new appurtenant easements captured over existing easement parcels, provided they are captured in 2 different layers, that is, one is ‘Secondary’ the other ‘Tertiary’.
 

C. Existing subject easements (for example, on a primary parcel created in this survey) to be retained that are already spatially captured in Landonline

  1. Capture non-primary parcels for all existing easements that you want to retain into the dataset.
  2. Enter appellations based on the new plan.
  3. Capture any intersections between new and existing easements as separate parcels if the parcels are in the same topology layer. This is a Landonline topology requirement, not a requirement of the Cadastral Survey Rules 2021.

When creating intersections between new and existing easements, you need to ensure the entire existing easement is represented by a combination of the non-primary parcels included on your plan.

D. Existing subject easements to be retained that are not spatially defined on a CSD

You do not need to capture existing easements that:

  1. are to remain with the land, and
  2. have not previously been spatially defined on an approved CSD.

However, you must annotate them in a Schedule of Existing Easements. Use the appellation for the underlying parcel as the easement parcel identifier, that is, if the easement is known to be over Lot 1 DP 123, the easement parcel identifier will be ‘Lot 1 DP 123’.

E. Easements on Unit datasets

  1. Show subject easements existing against the underlying primary parcel (that is, the fee simple estate) on the plan graphic and in a schedule.
  2. Include existing appurtenant easements in the Schedule / Memorandum. If spatial parcels exist in Landonline for existing appurtenant easements, reference these in the Existing Parcels Panel.
  3. Capture new subject or appurtenant easements over the base land or other land into Landonline and show on the diagram of parcels.
  4. Reference underlying primary parcels for new appurtenant easements in the Existing parcels panel

F. Existing centreline easements

If the existing centreline easement is split by a new primary parcel, capture it as 2 polygon parcels where the width is known.  

If vectors exist in Landonline, you can adopt them.

Intersecting centreline easements

Centreline easements can cross over each other, provided they are captured in 2 separate layers (that is, one Secondary Centreline, the other Tertiary Centreline).

If they are both the same layer, you need to capture the intersections, but you can link the portions as 1 centreline parcel (see following point below).

You can link multiple centreline segments as 1 centreline parcel where they are all contained in 1 primary parcel. Add underlying centreline easement parcels to the Existing parcels panel as ‘extinguished’.

H. Existing easements to be surrendered

If you surrender all rights in an underlying non-primary parcel (easement), you must extinguish the underlying non-primary parcel if it exists in Landonline.
