Steps to apply for permission to use Crown lands and properties managed by Toitū Te Whenua.

1. Check if the land or property you are interested in is managed by us

2. Submit an Expression of Interest

If you have confirmed that the land and/or property you want to use is managed by us, or are not able to confirm, use our Crown property contact form to submit an Expression of Interest.

How to complete the Crown property contact form

  • Your details - add your contact information.
  • Your submission
    • Topic - select ‘Expression of Interest to use Crown Land’. 
    • Location related to your submission - write where the land and/or property is. 
    • Submission details - include information on the activity you want to do, the timeframe for use, and anything else you think we should know.
  • File upload - please upload the map image of the location you are interested in. 

Things we'll consider

Expressions of Interest will be reviewed based on the following considerations.

  • Proposed activity - for example gravel extraction, Council recreation use, infrastructure, biosecurity/biodiversity work, tourism.
  • Area of land - for example is it managed by LINZ and available for use or needed for a Treaty settlement, due for disposal or already subject to other arrangements.
  • Timeframes.
  • Potential benefits - for example community/regional, environmental and cultural.

3. Receive notification from us

We will notify you if your Expression of Interest meets the criteria to progress or not.

If your request can progress, we will send you the following.

  • Application form - for you to provide the information we need.
  • Invoice - for the application processing fee. 

4. Submit application form and pay fee

When you've submitted the form and paid the fee our team will start the application assessment process.

Application assessment process

Applications for activity on land and property managed by us will be assessed to see if it fits within the statutory framework we need to apply, and a recommendation is made.

In some cases, we may need to:

  • get expert, valuation or legal advice
  • consult with iwi or others, for example the Department of Conservation
  • visit the site.

If your application is successful we will get in touch to negotiate an agreement and discuss the terms and conditions.

5. Receive the decision 

Once we've assessed your application we will send you confirmation of our decision by email or post.

If your application is declined, or you are not happy with the conditions of your agreement, you may be able to apply for a rehearing and/or can make a complaint.
