Types of discharges or withdrawals
The types of discharges or withdrawals you can prepare are:
- Full discharge/withdrawal (Titles mode)
- Partial discharge/withdrawal as to a share or interest (Share/Interest mode)
- Partial discharge/withdrawal of part of land or complex discharge (Complex mode).
The mode options and fields available will depend on the type of discharge or withdrawal you’re preparing.
The details for the registered owner will not display for affected titles subject to a withholding direction (hidden title).
Partial discharges of mortgages for boundary adjustments
When doing a boundary adjustment, if only part of the land in a title affected by the mortgage is to be discharged (the part being transferred to the adjoining owner), you must:
- Select Complex mode.
- Enter the description of the part affected.
If you don't select Complex mode then the mortgage will be discharged as to all of the affected title.
If this happens by mistake, the certifying lawyer would be responsible for the consequences. That would include any costs associated with registering further mortgage documentation to fix the matter.
