Reasons for decision

The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A Land Act and that the terms and conditions specified in the attached permit will minimise any potential adverse effects of the proposed activities on inherent values that it is considered desirable to protect. 

Conditions of decision

Consent is granted for hiking, heli hiking, heli mountain biking, heli picnicking, heli skiing and horse trekking subject to the following conditions:

  1. Not remove any vegetation, disturb any soil or light any fire on the Operational Area other than as provided for in Clause 11 below.
  2. Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area other than as provided for in Clause 12 below.
  3. Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit.
  4. Adhere to the Environment Care code and Water Code and remove and take away or cause to be removed and taken away all refuse.
  5. Comply with the provisions of the current Health and Safety in Employment Act 2015 and or any other later enactment. 
  6. Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
  7. Ensure mountain bikes and horses remain on tracks shown on the plan in the Second Schedule or on existing stock tracks.
  8. Take all reasonable precautions to guard against danger on the Grantor’s land.
  9. Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
  10. Comply at all times with the provisions of the Biosecurity Act 1993, including compliance with guidelines for limiting the spread of Didymo as published by the Ministry of Primary Industries. Refer to www.mpi.govt.nz/didymo for the latest information.
  11. The blue line on the attached plan indicates the proposed location of a new mountain bike track, the formation of which the Commissioner of Crown Lands has approved with conditions, and which when formed will be considered approved for use under this Permit. 
  12. A shelter and toilet facilities may be constructed in the vicinity of the Winterton River/George River Saddle subject to consent for the location and construction being approved by the Commissioner of Crown Lands before construction commences.

Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
