Decision Date | 12 April 2024 |
Pathway | Sensitive land – Residential land development (one off) |
Investment | Acquisition of a freehold interest in approximately 0.0766 ha at 16 Williamson Avenue, Belmont |
Consideration | $2,600,000 |
Applicant | Star Jasmine Development Limited |
Vendors | Dabin Wang |
Background | The Applicant is a property development company, ultimately majority owned by a Chinese citizen. This is a retrospective consent as the Applicant acquired the land without consent and subsequently applied for consent to amalgamate the titles for 14 and 16 Williamson Avenue. LINZ considered that the breach was inadvertent and required the Applicant to apply for retrospective consent for the original purchase. The Land was used for residential purposes prior to the Applicant’s acquisition, with a single dwelling on the Land. The Applicant demolished the single dwelling and built 8 new dwellings on the Land. The Applicant intends to sell the newly constructed dwellings. Retrospective consent was granted as the Applicant met the investor test criterion and the investment is likely to result in an increased housing outcome. |
