Reasons for decision

For the part of the consent that was granted:

The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of Section 66A of the Land Act 1948 and that the terms and conditions specified in the attached permit will minimise any potential adverse effects of the proposed activity and that, as a result, the adverse effects on the inherent values will be no more than minor. Amendments to the permit document are also to comply with the requirements of LINZS45002.

Conditions of decision

Consent is granted for filming, subject to the following conditions:

  1. Not at any time cause any permanent building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area. The Grantee may place temporary structures as prescribed in the application.
  2. Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit. 
  3. Remove and take away or cause to be removed and taken away all materials, structures, contaminants, human waste, refuse, vehicles, equipment and vegetation placed on the site for the purposes and activities.
  4. Ensure that any damage or disturbance to the surface of the land as a result of the activities allowed by the Permit is restored to its former condition to the reasonable satisfaction of the Grantor and Lessee.
  5. Ensure that all vehicle use is kept to formed tracks.
  6. Comply with the provisions of the Health and Safety at Work Act 2015.
  7. Hold and maintain a comprehensive Health & Safety Plan which addresses the hazards and risks associated with operating the activity.
  8. Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
  9. Ensure the activities authorised by this permit will be confined to the planned route depicted in red in the Third Schedule. Consent from the Grantor must be sought in advance for any variation to the Third Schedule. The Grantor may approve or decline a request to vary the Third Schedule at their discretion.
  10. Take all reasonable precautions to guard against danger on the Grantor’s land.
  11. Not to interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
  12. Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo as published by Biosecurity New Zealand.
  13. Take all reasonable precautions, in relation to any motor vehicle to prevent the accidental starting of any fire, particularly at times of high fire risk.
  14. Only light fires in properly constructed containment areas away from vegetation. Any fire must be supervised at all times and extinguished before sleeping. 
  15. Prepare a fire action plan and keep on-site appropriate fire extinguishers, shovels, and/or knapsack sprayers for use in the event of fire.
  16. Be aware that the Operational Area could be subject to Part IVA Conservation Act 1987. Therefore, marginal strips may be present within the Operation Area, these are administered by the Department of Conservation and are excluded from this permit.
  17. For the protection of birds, when using a drone, the permit holder must:
  18. Immediately cease the operation of the drone, or not start using the drone if there is any indication of birds (including chicks or nests) in the immediate area of the drone.
  19. Take off at least 100m from any birds (including chicks or nests).
  20. Land their drone immediately if a bird circles or otherwise interacts with a drone flight.
  21. Land their drone at the first sight of any birds (including chicks or nests) being disturbed.
  22. Fly at least 50m or more from any protected wildlife on the land.
  23. Avoid flying more than three drones within 300m of any wildlife.
  24. The crew and cast must never feed Kea and are to avoid leaving temptations around such as loose clothing and boots, packs, food and brightly coloured objects.
  25. To mitigate the impacts of filming on kea, drones must not be active if kea are visible from the filming site.
  26. For the protection of native vegetation, waterways and braided river ecology the crew and cast must:
  27. No vegetation or other natural features can be cut back or removed to improve shots, camera angles, facilitate access to the sites or for use in any rigging.  
  28. Vehicles must be parked, and helicopters must land on firm ground.
  29. Any bolts installed are to be overdrilled into the rock and covered up with rock and dust from the surrounding area.
  30. The applicant must ensure that the rigging crew keep fixed anchors to a minimum.
  31. Comply with the “leave no trace” principles. (www.leavenotrace.org.nz), ensure all rubbish is removed and that sites are left in the same or better condition in which they were found.
  32. Comply and ensure crew and cast comply with MAF Biosecurity New Zealand, Check, Clean, Dry-cleaning methods to prevent the spread of Didymo (Didymosphenia geminate) and other freshwater pests when moving between waterways.   33. All equipment, clothing or footwear that may come into contact with waterways must be cleaned before and after visiting the sites to these standards.
  34. The permit holder must ensure only essential crew go onto the riverbed.
  35. The permit holder must ensure people do not come within 50m of any native river bird colony exhibiting nesting or defensive behaviour. Defensive behaviour can include swooping or feigning injury or general agitated behaviour. The nesting season occurs mainly between August and January inclusive.
  36. If any birds are disturbed people must walk away from the site as quickly as possible.
