Reasons for decision

The Commissioner of Crown Lands has determined that the benefits from being able to maintain the existing tracks are significant. Maintenance of the tracks will make it safer and easier to move stock around the lease, for farm management, and improve the control of wilding trees and other weeds and pests. It is considered that any adverse effects on inherent values can be avoided, remedied or mitigated by the conditions placed on the CCL approval. 

Conditions of decision

Consent is granted, subject to the following conditions:

  1. That track maintenance is limited to the areas as indicated on the map attached to the Notice of Decision.
  2. The track maintenance shall only occur within the existing footprint of the tracks. None of the tracks shall be widened further.
  3. That soil disturbance is kept to the minimum necessary for the maintenance and that appropriate machinery is employed on the task to achieve this.
  4. The track may be maintained to a level suitable for the purpose for which they were designed. 
  5. That all machinery intended to be used for maintaining the track is cleaned of plant material and soil prior to entering Ben Lomond Station to avoid weed contamination.
  6. Any replacement of water crossings, either hard based or culverts must allow for fish passage.
  7. That all contractors and employees working on Ben Lomond Station engaged in the track maintenance are informed of the conditions of this consent prior to works starting.
  8. To be clear this consent replaces previous consents granted for tracking to Ben Lomond Special Lease. This includes the Notice of Decision dated 27 August 1999 for track maintenance. 

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
