Reasons for decision

For the part of the consent that was granted

The Commissioner of Crown Lands has determined that granting consent to allow new cultivation will make it easier to use the land for farming purposes, and that any adverse effects on inherent values can be minimised through compliance with the conditions specified above.

For the part of the consent that was declined

The commissioner has determined that there are wetland values within the area identified relating to water quality and the presence of native Carex spp.

Conditions of decision

Consent is granted in part for cultivation, subject to the following conditions:

  1. No direct drilling activity within the area shown in red on the attached plan or within 3m of any seasonal or permanent waterbody or wetland.
  2. Temporary fencing is to be erected around the waterways/wetlands shown in red on the attached plan if the adjoining cultivated land is grazed by cattle.
  3. Using minimum cultivation/ direct drilling /cover crops and rough/ seed bed techniques to ensure soils are not over worked and exposed to wind erosion.
  4. Species that may be planted include lucerne, ryecorn, pasture grasses, herbs and clovers.
  5. Restricting the return cultivation cycle (two cultivations) to not more than once in every 8 years.
  6. Ensuring that continued inputs of maintenance fertilizer are applied to extend the effective life of permanent pasture stands which will reduce the need for renewal cultivation.
  7. The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.

Consent is declined to cultivate approximately 2ha within the area shaded red on the attached plan.
