Reasons for decision

Granting consent to construct and maintain the fence lines as requested will make it easier to use the land for farming purposes, and any adverse effects on inherent values can be minimised through compliance with the conditions outlined below.

Conditions of decision

Consent is granted for soil disturbance to construct three fence lines, subject to the following conditions:

  1. Soil disturbance shall only occur where necessary for effective fence construction with the minimal width required to access and construct the fences.
  2. Avoid rock outcrops when flattening ground for fence lines and do not allow spoil to cover or disturb any such rock outcrops.
  3. Avoid disturbance to any wetlands and flowing streams.
  4. Soil disturbance shall be carried out in a manner that will not cause water to be channelled.
  5. All machinery used is to be thoroughly cleaned and free of weed seeds prior to any works.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
