Reasons for decision
The proposed activity is one which comes within the provisions of Section 66A of the Land Act 1948, and that the terms and conditions specified will minimise any potential adverse effects of the activity. As a result, the adverse effects on the inherent values will be no more than minor.
Conditions of decision
Consent is granted for the event on the area identified in the attached plan as the ‘Operational Area’, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
- Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
- Comply at all times with all statutes and regulations and obtain all approvals, consents, licences and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit.
- Remove and take away or cause to be removed and taken away all materials, contaminants, human waste, refuse, vehicles, equipment and vegetation placed on the Operational Area for the purpose of the activities set out in the First Schedule of this Permit.
- Ensure the "Leave No Trace" Principles of Leave No Trace New Zealand and the New Zealand Environmental Care Code are adhered to at all times however for the avoidance of doubt if any inconsistencies exist between these principles and the Grantee’s obligations outlined herein these Grantee obligations shall override at all times.
- Ensure that the Grantee’s clients have access to proper toilet facilities prior to entering onto the Operational Area.
- Ensure that any damage or disturbance which has occurred to the surface of the land as a result of the activities authorised by this Permit is restored to its former condition and to the reasonable satisfaction of the Grantor and Lessee.
- Comply with the provisions of the Health and Safety at Work Act 2015.
- Ensure that the activities authorised by this Permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this Permit.
- Take all reasonable precautions to guard against danger on the Operational Area, including but not limited to, ensuring, other heliski operators within the Operational Area are aware of the intended activity prior to it being undertaken and notify the Commissioner of Crown Lands, within a reasonable timeframe, of the actual Operational Area once confirmed.
- Use only formed and existing tracks on the land within the Operational Area to avoid damaging native vegetation and the Grantee shall not deviate from the said tracks and shall not construct new tracks without prior written consent of the Grantor.
- Ensure the activity only occurs when trails/tracks are designated ‘Open’. The Grantee will make all necessary enquires to ensure that the trails are ‘Open’ and not closed for track maintenance work (or any other reason) prior to entering onto the Operational Area.
- Operate the activities authorised by this Permit within the Operational Area, in a professional, safe and reputable manner in accordance with industry standards, if any.
- Not to interfere or obstruct the Grantor or his/her agent’s employees, contractors or authorised invitees or hinder or interfere with the Lessee’s farming operations on Minaret and Mt Albert pastoral leases.
- The applicant must comply and ensure its clients comply with the MAF Biosecurity New Zealand, Check, Clean, Dry cleaning methods to prevent the spread of Didymo (Didymosphenia geminate) and other freshwater pests when moving between waterways.
- To ensure protection of local kea birdlife, athletes and crew must not feed kea and are to take all reasonable steps to avoid leaving items unattended e.g. such as loose clothing and boots, packs, food, and brightly coloured objects.
- Alpine wetlands are to be avoided.
- All recreational users are advised not to disturb any archaeological or historical sites
- Ensure that appropriate signage is installed notifying participants, and any other affected parties including the general public, are aware of the activity being operated.
- Hold and maintain a comprehensive Health & Safety Plan which addresses the hazards and risks associated with operating the activity, including but not limited to, natural risks, extreme weather and the participant’s wellbeing.
Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
