Reasons for decision

The Commissioner of Crown Lands has determined that the proposed activity comes within the provisions of section 66A Land Act 1948. The terms and conditions will minimise any potential adverse effects from the proposed activities on inherent values present in the area.

Conditions of decision

Consent is granted subject to the following conditions:

  1. Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
  2. Not at any time cause any building, erection, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
  3. Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit. In particular, but without limitation, the Grantee must ensure that at all times during the conduct of the Activities that the use and possession of any firearms (whether by the Grantee or otherwise) complies in all respects with the provisions of the Arms Act 1983 (and regulations under that Act) and the provisions of the Arms Code.
  4. Remove and take away or cause to be removed and taken away all refuse.
  5. Comply with the provisions of the Health and Safety at Work Act 2015.
  6. Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
  7. Take all reasonable precautions to guard against danger on the Grantor’s land.
  8. Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
  9. Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo (Didymosphenia geminate) published by Biosecurity New Zealand.
  10. Not use vehicles prohibited by the Grantor.
  11. Maintain and repair tracks, fences, gates, buildings and other structures.
  12. If camping outdoors, ensure all cooking and heating requirements are to be by gas only.
  13. Restrict all vehicle activity to existing constructed tracks and acknowledge that “wander at will” is not permitted.
  14. Not be entitled, in any way, to keep Himalayan tahr or chamois captive within any part of the Operational Area unless holding an appropriate permit or licence granted by the Department of Conservation under the Wild Animal Control Act 1977.
  15. Ensure that non-captive Himalayan tahr numbers on the Operational Area meet the requirements of the Himalayan tahr Control Plan administered by the Department of Conservation under the Wild Animal Control Act 1977.
  16. Ensure that all vehicles are equipped to minimise the risk of accidental fire and at least one vehicle in each party to be fitted with an operative fire extinguisher, shovel and hand fire beaters. Should the fire danger be rated as high or extreme, vehicle tours should not take place.

Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
