Reasons for decision
The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A of the Land Act 1948 and that the terms and conditions specified in the permit will minimise any potential adverse effects of the proposed activities.
Conditions of decision
Consent is granted for filming, subject to the following conditions:
- Not remove any vegetation, disturb any soil or light any fire on the Operational Area.
- Not at any time cause any building, reception area, structure or fence or alteration or addition thereto to be placed or carried out upon the Operational Area.
- Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this Permit.
- Remove and take away or cause to be removed and taken away all refuse and human waste from the Operational Area.
- Comply with the provisions of the Health and Safety at Work Act 2015.
- Ensure that the activities authorised by this permit will be confined exclusively to the Operational Area (as defined on the map attached as the Third Schedule) and use the Operational Area solely for the activities authorised by this permit.
- Ensure that participants keep to all formed tracks wherever possible.
- Take all reasonable precautions to guard against danger on the Grantor’s land.
- Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
- Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo (Didymosphenia geminate) published by Biosecurity New Zealand.
- Ensure that any damage or disturbance to the Land caused as a result of the permitted activity will be restored to its former condition.
- Ensure landowner consent is sought should any additional land be required for the activity and/or access.
- Comply with the Department of Conservation’s recommendations and special conditions which are attached at the Fourth Schedule.
- Engage a suitably qualified bird ecologist where recommended by the Department of Conservation to assess the Operational Area for the presence of nesting birds and specify setbacks where applicable. The Grantee shall send any survey reports to the Grantor prior to the activity commencing.
- Acknowledge that they have non-exclusive access over the land, including access roads/tracks.
- Hold a comprehensive Health & Safety Plan which acknowledges that the Land is prone to flooding.
- Not store any equipment or vehicles on the land overnight.
- Ensure that all drone use complies with the Civil Aviation Rules part 102 and that all drone operators hold appropriate certificates.
- Display appropriate visible signage in the areas where the activity is taking place notifying the public that there is hazardous activity on the Land and warning members of the public accessing the Land.
- Keep to formed tracks where possible and avoid damaging any native vegetation.
- Only drive essential vehicles onto the riverbed.
- Not manipulate the land or disturb wildlife, vegetation or habitats for the purposes of accessing a better camera angle or shot.
- Not light any fire or use any flares. The Grantee may use a Cold Spark Sparking Fountain and smoke bombs for special effects providing that:
- The Grantee notifies Fire & Emergency New Zealand with 48 hours’ notice.
- Fire & Emergency New Zealand does not have any concerns with use of the special effects equipment.
- The Grantee provides verbal warning to any nearby members of the public prior to use of the special effects equipment.
- Acknowledge that the Grantor has granted a non-exclusive Access Agreement to Doug Jones and Russel Knight for gold mining on the Shotover River. The Grantee acknowledges that this Recreation Permit is also non-exclusive, and the Grantee shall act reasonably to coordinate their activities, should it be necessary.
- Notify all commercial users of Skippers Road of the proposed activities on the Shotover River, and any necessary temporary road closures.
Fourth Schedule - Special conditions relevant to the pastoral lease imposed by the Department of Conservation:
- The concessionaire must comply and ensure its clients comply with the MAF Biosecurity New Zealand, check, clean, dry-cleaning methods to prevent the spread of Didymo and other freshwater pests when moving between waterways. The concessionaire must regularly check this website and update their precautions accordingly.
- All equipment, clothing or footwear that may come into contact with waterways must be cleaned before and after visiting the sites to these standards.
Recreation permits granted by the Commissioner of Crown Lands also incorporate (with minor variations) the terms set out in Appendix H of the the Standard for purchase, alienation, and administration of Crown land - LINZS45002.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
