The Public Works Act 1981 sets out the procedures for disposing of land that is held for a public work but is no longer required for that public work. This Standard ensures that those who have a recognised interest in the land are given priority when the land is disposed of. This Standard and Guideline are published to ensure that all those with a recognised interest in land held for a public work are considered when that land is disposed of by Government vendor agencies.
It is important that recognised interests in the land be addressed in order of priority and using the correct processes.
The guideline provides guidance and best practice in the processes for disposal of land held by the Crown under the Public Works Act 1981, and on the information required by Toitū Te Whenua Land Information New Zealand to enable it to fulfil its statutory obligations. Both documents will assist vendor agencies when disposing of land under the Public Works Act 1981.
