Reasons for decision

The Commissioner of Crown Lands grants consent to an exemption to the stock limitation in the lease to allow the leaseholder to carry the following stock:

  • 6,500 sheep (including up to 5000 breeding ewes)
  • 400 cattle (including up to 200 breeding cows)

The stock exemption is the same as the exemption granted to the previous lessees and the Commissioner is satisfied that the provisions of s 15(4) Crown Pastoral Land Act 1998 have been met.

Conditions of decision

Consent is granted to an exemption to the stock limitation in the lease subject to the following conditions:

  1. Adequate levels of fertiliser must be applied to developed areas to maintain or improve soil fertility; and
  2. Should the increased cattle numbers result in any adverse impacts on native tussock grassland and shrubland, as determined by property inspection or any other inspection by LINZ employees or contracted service providers, then the Commissioner may impose a reduction in the number of cattle that may be run on the Lease. This reduction shall allow the Commissioner to reduce the number of breeding cows by up to 50, and therefore reduce the total number of cattle permitted on the Kingston Pastoral Lease to 350; and
  3. That any known wetland areas or watercourses in the area to be grazed with cattle, if any, be fenced out; and
  4. That any gorse is activity controlled and wilding conifers near the boundary of Lorne Peak are removed (as discussed with the service provider) to prevent seed spread onto improved pasture; and
  5. That all fencing is to be fully maintained to confine cattle when grazing on improved pastures or other fenced areas of the lease.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
