Reasons for decision
The Commissioner’s delegate has determined that granting consent to cultivate the land has positive farming benefits that outweigh negative impacts on inherent values that it is desirable to protect. Conditions have been imposed to ensure that the inherent values associated with wetlands and the associated shrublands which include inherent values that the Commissioner wishes to protect are maintained.
Conditions of decision
Consent is granted subject to the following conditions:
- Cultivation is not to be carried out within wetlands, seepages and watercourses including a minimum riparian margin of 10m; and
- Slopes greater than 20 degrees are not to be cultivated; and
- Cultivation is to occur across slope to reduce the risk of soil erosion; and
- Disturbed areas are to be revegetated with permanent pasture species only; and as soon as possible (not exceeding 3 months); and
- Cultivated areas are to be maintained with adequate fertiliser as indicated by soil testing; and
- The areas may be re-cultivated back into permanent pasture not more frequently than eight year intervals.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
