Reasons for decision

The Commissioner noted that the track had been constructed prior to obtaining consent in an environment where the track has had a detrimental effect on inherent values. The Commissioner also noted that in your application that the track did not have ongoing farm management purposes other than fence maintenance. It was therefore determined that the track should be allowed to naturally regenerate, but during that time further adverse effects on inherent values should be avoided.

Conditions of decision

Consent is granted for forming a track subject to the following conditions:

  1. That no further work is undertaken on the track other than to meet the conditions below and that the track is allowed to revegetate.
  2. The track is to be inspected by representatives of the lessee at least twice yearly for a minimum of five years from the date of this letter to ensure that conditions 3 and 4 are being met.
  3. Water is to be directed off the track surface to prevent scouring in a manner that does not introduce sediment into the creek or wetlands.
  4. Any exotic weeds are to be removed as soon as they are observed.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
