Reasons for decision

The Commissioner of Crown Lands has determined that the proposed activity is one which comes within the provisions of section 66A Land Act 1948, and that provided the terms and conditions specified in the attached permit are adhered to, these will minimise any potential adverse effects of the proposed activities on inherent values that it is considered desirable to protect. 

Conditions of decision

Consent is granted for the recreation permit, subject to the following conditions:

  1. Not remove any vegetation or disturb any soil on the Operational Area except as provided foraging purposes. Only the minimum required for personal consumption of edible vegetation may be removed. The Grantee is to seek their own advice and advise participants what is edible.
  2. Only light fires in properly constructed containment areas away from vegetation and in accordance with any fire permits required. Any fire must be supervised at all times and extinguished before sleeping.
  3. Prepare a fire action plan and keep on-site appropriate fire extinguishers, shovels, and/or knapsack sprayers for use in the event of fire.
  4. Comply at all times with all statutes and regulations and obtain all approvals, consents and authorisations as are necessary for the Grantee to conduct the activities permitted by this permit.
  5. Remove and take away or cause to be removed and taken away all materials, structures, contaminants, refuse, vehicles, equipment and vegetation placed on the site for the purposes and activities set out in the First Schedule.
  6. Where no toilet facilities are available all solid waste shall be carried out, or appropriately deposited in shallow holes dug in the topsoil at least 50 metres from any water or track, inorganic material such as sanitary products shall be packed out in suitable containers and disposed of at an appropriate facility.
  7. Ensure that no processing of any animals hunted as part of the Activities shall occur within 50 metres of any water body, water source or public road or track and no carcasses, offal or rubbish from the said processing is to be left in streambeds or within 50 metres of any water body, water source, public road or track.
  8. Ensure that any damage or disturbance to the surface of the land as a result of the activities allowed by the Permit is restored to its former condition to the reasonable satisfaction of the Grantor and Lessee.
  9. Ensure that all vehicle use is kept to formed tracks.
  10. Comply with the provisions of the Health and Safety at Work Act 2015.
  11. Hold and maintain a comprehensive Health & Safety Plan which addresses hazards and risks associated with operating the activity.
  12. Ensure that the activities authorised by this Permit will be confined exclusively to the Operational Area and use the Operational Area solely for the activities authorised by this permit.
  13. Take all reasonable precautions to guard against danger on the Grantor’s land.
  14. Not interfere or obstruct the Grantor or his/her agent’s employees or contractors or authorised invitees.
  15. Comply at all times with the provisions of the Biosecurity Act 1993 and the Biosecurity New Zealand guidelines, including compliance with guidelines for limiting the spread of Didymo as published by the Ministry of Primary Industries at Check, Clean, Dry: preventing didymo and other pests | NZ Government (mpi.govt.nz)
  16. Take all reasonable precautions, in relation to any motor vehicle to prevent the accidental starting of any fire, particularly at times of high fire risk.
  17. Ensure that all vehicles and gear are thoroughly clean of any soil and vegetative matter to prevent the introduction of weed seeds from outside the area, such as broom, gorse, Spanish heath and old man’s beard.
  18. Ensure nesting birds are not disturbed.
  19. Ensure no dogs are permitted on the riverbeds or at the camping site.
  20. Comply to the international “Leave No Trace” Principles at all times (www.leavenotrace.org.nz).
  21. Leave no food or food waste on the Operational Area available for exploration by kea, including during the hours of darkness. This includes keeping all food and rubbish in solid containers that kea cannot access (plastic bags are not adequate protection).
  22. Be aware that part of the Operational Area could be subject to Part IVA Conservation Act 1987. Therefore, marginal strips may be present within the Operational Area. These are administered by the Department of Conservation and are excluded from this permit.
