Reasons for decision
The Commissioner’s delegate has determined that granting consent to spray gorse and exotic broom will make the land easier to farm and this outweighs any minor impacts on inherent environmental values which are largely mitigated through the conditions imposed by this notice.
Conditions of decision
Consent is granted to spray gorse and exotic broom within an area of approximately 20.65ha shaded pink, on the attached map, and marked as areas 9-13 and 15-27, subject to the following conditions:
- Spraying activity in relation to this consent must not occur outside the areas marked on the plan.
- Spraying is limited to exotic weed control and by-kill is to be avoided wherever practicable through the targeted application of spray in appropriate weather conditions and by using skilled persons or operators.
- To limit damage to surrounding native scrublands and bush all herbicide is to be applied by hand or if by helicopter, using only a wand.
- The sub-lessee and all contractors and employees of the consent holder are to be informed of the conditions of this consent and the requirement to comply with them prior to any spraying commencing.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
