Reasons for decision

The area contains a number of inherent values including landscape values, shrubland ecosystems and wetlands. A range of native plants, invertebrates, lizards and bird species are also present. The Commissioner of Crown Lands has determined that granting consent to disturb soil to form the fencelines as requested will make it easier to use the land for farming purposes, and that any adverse effects on inherent values can be minimised through compliance with the conditions specified.

Conditions of decision

Consent is granted to disturb soil to form fencelines, subject to the following conditions:

  1. Any new fencelines are to have a maximum width of 2 metres and where practical, the general ground cover should remain intact.
  2. Soil disturbance to be undertaken utilizing an excavator.
  3. Cut-outs shall be installed every 30-50 metres in steeper sections, in order to minimize runoff and scouring.
  4. The fence alignment shall avoid areas of dense shrubland where possible. Fence 4 is to avoid dense shrubland in the gully.
  5. Fencelines shall be sown with grass as soon as possible.
  6. All machinery used in construction is to be thoroughly cleaned and free of weed seeds.

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
