Reasons for decision
The Commissioner’s delegate has determined that granting consent to disturb soil to construct a building and form tracks, subject to the conditions outlined below, will also protect the inherent values noted by the Director-General of Conservation. The conditions provide appropriate precautions which will mitigate the potential adverse effects on inherent values.
Conditions of decision
Consent is granted subject to the following conditions:
- Soil disturbance up to a total area of 560 square metres is permitted within the Operational Area as shown on the attached plan, for excavation to construct an appropriately designed hangar building and apron slab foundations.
- Surplus excavated soil from the building site or track footprint is to be spread around the building site or in the immediate surrounding improved pasture and reseeded as soon as practicable to maintain the existing aesthetic.
- Disturbed soil is to be re-seeded and topdressed with a certified weed and impurities-free permanent pasture mix as soon as possible after completion of the activity.
- Appropriate measures are to be taken to ensure excess soil and sediment does not wash into Phoebe Creek riverbed.
- Any contractors’ on-site fuel and oil storage facilities are to be located in such a way as to eliminate the possibility of a leak or spill into any waterways.
- That track formation is limited to the approved areas as shown on the plan attached.
- That soil disturbance associated with the construction of tracking is to be kept to the minimum required to meet the objectives.
- That all machinery intended to be used to construct the track is cleaned of plant material and soil prior to arriving on site to avoid weed contamination.
- Comply at all times with Queenstown Lakes District Council consent notice RM230223 and its associated conditions.
- The lessee is allowed to maintain the ‘existing shelterbelt’, as identified in the attached plan Operational Area, between co-ordinates X 1273212 Y 5057579 and X 1274031 Y 5057652 (New Zealand Transverse Mercator 2000), with a non-wilding tree species in order to maintain vegetation screening of the hangar building.
- The lessee is responsible for ensuring that any contractors or employees of Matukituki Station adhere to the conditions of this consent notice and are aware of them prior to the work commencing.
- Any changes to the design or location of the proposals from that in the application requires further written approval from the Commissioner.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
