Reasons for decision
The Commissioner has determined the area which soil disturbance will occur on will both provide a fence line while protecting the inherent values present given the above conditions.
Conditions of decision
Consent is granted for soil disturbance (for creating a fence line) subject to the following conditions:
- That the areas of disturbed soil are regularly checked for weeds that may have been present on the machinery when the soil disturbance was undertaken.
- That any topsoil resulting from excavations is disposed of in a tidy manner.
- That any track batters and earth disturbance areas be revegetated as soon as practicable.
- That cut-outs are installed every 30-50m in steeper sections, in order to minimise runoff and scouring.
- That any fencing crossing any waterway does not impede fish passage.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
