This standard sets out the procedures to be followed and provides guidance for the stopping of road under the Public Works Act 1981 and the Local Government Act 1974 (LGA) and the resumption of unformed road by the Crown from territorial authorities under the s 323 of the LGA.
The purpose of this standard is to ensure that the Minister’s role in road stopping or resumption is correctly carried out and that, where applicable, the protocols the Crown has with Ngāti Mutunga and Ngāti Tama are followed where it is proposed to resume an unformed road.
