[1] AP17 can be used for an Application for Record of Title under ss 155, 172 or 204 Land Transfer Act 2017. The mortgagee consent requirement applies only to applications made under ss 172 and 204 (if applicable).
[2] A cross lease requires the consent of every mortgagee of a share of the fee-simple estate affected by the cross lease – s91(4) Land Transfer Act 2017. The same requirement applies to mortgagees of shares in a head lease when a leasehold estate is being cross leased.
