For the part of the consent that was granted
The Commissioner has determined it is necessary to clear top-dressing-induced scrub in the consented area in order to maintain pastoral activity. The Commissioner is also aware of a number of inherent values associated with shrubland that it is desirable to protect. The conditions to the consent are intended to achieve the balance between pastoral use and protecting the inherent values.
For the part of the consent that was declined
The Commissioner’s delegate has determined there are inherent values associated with shrublands that will be adversely affected by clearing. These adverse effects will be minimised if the declined areas are avoided.
Conditions of decision
Consent is granted in part for clearing scrub, subject to the following conditions:
- Spraying is limited to the control of sweet briar, gorse, broom, matagouri, mānuka, kānuka and coprosma.
- No spraying within the areas shown in red on the plan attached to the notice of decision, other than spot spraying of exotic weeds and maintaining existing stock access routes.
- No spraying of rocky outcrops or within 10 metres of all permanent water courses, except for spot spraying of exotic weeds.
- Spraying is to be undertaken in accordance with best practice industry standards and to avoid non-target species.
- Chemical not to exceed 250 grams/hectare of Metasulfuron and 4 litres/hectare of Tordon (or equivalent) with a wetting agent.
- Not more than 50 hectares to be sprayed in any one year.
- No area to be sprayed more than once within the 20-year term
- Consent can be revoked before the end of the term at the discretion of the Commissioner of Crown Land should the conditions of the consent not be complied with.
The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
Consent is declined for clearing scrub within the areas shown in red on the attached map.
