Reasons for decision

The Commissioner of Crown Lands has determined that restricting shingle excavations to the current footprint will avoid impacts on inherent values associated with the Cass River outwash, and continued use of the shingle with appropriate precautions will enable maintenance of tracks and pivot ruts making it easier to use the lease for farming purposes.

Conditions of decision

Consent is granted to disturb soil, subject to the following conditions:

  1. Shingle may be extracted from the shingle pits shown outlined in blue on the plans, for use on Glenmore pastoral lease and any adjacent freehold land owned and farmed by the lessee. 
  2. The excavations may be deepened but may not be increased in surface area. 
  3. Shingle may be stored within the area outlined in red. 
  4. There is to be no further dumping of rubbish into the shingle pits. Recycling is encouraged where possible. 
  5. Any materials dumped within the shingle pits that could be causing contamination of groundwater are to be removed and safely disposed of. 
  6. Problem weeds growing in the shingle pits are to be controlled to avoid seeds being spread across the lease track network. 
  7. Shingle may continue to be extracted beyond the term of this consent provided: 
    1. The surface area of extraction is not increased from that shown outlined in blue on the plans attached. 
    2. There are no adverse effects on the environment. 
    3. Consent under any other enactments that may be applicable is obtained. 

The Crown Pastoral Land Act 1998 provides that permission to undertake the activity may still be needed under other enactments.
