We are seeking feedback on the draft Authority and Identity Requirements for E-Dealing Standard and the Authority and Identity Requirements for E-Dealing Guideline.

This consultation has now closed. Submissions have been considered as set out in the Decisions and Reasons Paper below. 

Overview

The current Authority and Identity Requirements for E-Dealing Standard and Guideline issued in 2018 set standards and provide guidance to lawyers and conveyancers on requirements for obtaining proper authority and confirming client identity when certifying property transactions for registration under the Land Transfer Act 2017.  

The standard and guideline have been reviewed to update and clarify these requirements. The proposed changes also extend the scope for practitioners to use audio-visual technology to remotely obtain authority from and confirm the identity of their clients and enables the use of verifiable electronic signatures. This builds on interim measures introduced by the Registrar-General of Land to allow property transactions to continue during the COVID-19 restrictions, that the legal profession and conveyancers have indicated they would like to see adopted on a permanent basis.
