Other caveats under the Land Transfer Act 2017

Information about caveats against applications for adverse possession, to bring deeds land under the Act, by adjoining owners for title to an access strip, and against the removal of limitations.

Caveats may be lodged by other interested parties in response to Land Transfer Act 2017 applications made by landowners and other parties.

Caveat against adverse possession application – s162

Information about lodging a caveat in response to an adverse possession claim is found in the Adverse Possession Guideline.

A caveat can be lodged using Form 38 of the Approved Electronic Forms (for registration by e-dealing) or the Approved Paper Forms (for a manual dealing). The instrument code is ‘XAPP’.

Caveat against bringing land under the Act – s174

A caveat against an application bringing land under the Land Transfer Act 2017 can be lodged using Form 40 of the Approved Electronic Forms (for registration by e-dealing) or the Approved Paper Forms (for a manual dealing). The instrument code is ‘XAPP’.

A caveat against an application by adjoining owners for title to an access strip can be lodged using Form 42 of the Approved Electronic Forms (for registration by e-dealing) or the Approved Paper Forms (for a manual dealing). The instrument code is ‘XAPP’.

Caveat against limited record of title limited as to parcels – s207

A caveat against a removal of limitations for limited title that is limited as to parcels can be lodged using the usual caveat against dealings template instrument in Landonline (for registration by e-dealing) or Form 44 of the Approved Paper Forms (for a manual dealing). The instrument code is ‘X’.
